ORDER GRANTING OBJECTIONS TO CERTAIN CLAIMS IDENTIFIED IN THE PLAN ADMINISTRATOR’S OMNIBUS OBJECTION TO CLAIMS DUE TO REJECTED CONTRACTS

This cause having come before the Court on the Plan Administrator’s Objections to Kiel Centers Partners, LP’s Claim Numbers 332 and 333 (collectively the “Objections”), as set forth in the Plan Administrator’s Omnibus Objection To Claims Due To Rejected Contracts (the “Omnibus Objection”), due and adequate notice of the Omnibus Objection and the hearing thereon having been given to those parties entitled thereto, the Court having considered the requested relief and the statements of counsel and all other parties-in-interest, the Court being fully advised in the premises and for good cause shown,

IT IS HEREBY ORDERED, ADJUDGED AND DECREED THAT:

1. The Objection to Kiel Centers Partners, LP Claim Number 332, as identified in the Omnibus Objection, is granted;

2. The Objection to Kiel Centers Partners, LP Claim Number 333, as identified in the Omnibus Objection, is granted;

3. The Objections, as identified in the Omnibus Objection, shall be disallowed in accordance with the table below:

4. This Order is made pursuant to the Court’s rulings from the bench on April 21, 2003;

No later than five (5) business days after the date of this order, counsel for the Plan Administrator is directed to serve a copy of the order to the attached Distribution List for Order Granting Objections to Select Claims Identified in the Plan Administrator’s Omnibus Objection to Claims Due to Rejected Contracts. Plaintiff is directed to file a certificate of service no later than two business days after service.
