IN MATTER OF LANNAN (Bankr.N.D.Ind. 2006)

IN THE MATTER OF: LANORA NECOLE LANNAN, Debtor.

Case No. 06-40131.United States Bankruptcy Court, N.D. Indiana, Hammond Division at Lafayette.
June 16, 2006

DECISION AND ORDER
ROBERT GRANT, Bankruptcy Judge

By the court’s order of June 1, 2006, the debtor was directed to demonstrate her eligibility for relief under Title 11 or show cause why the case should not be dismissed. The debtor did not respond to that order, unless the court construes her motion to voluntarily dismiss this case as a response. If so, it is insufficient. It does not do either of the things the court directed her to do — demonstrate her eligibility for relief or demonstrate why the case should not be dismissed.

Based upon what it has before it, the debtor has not fulfilled the requirements of 11 U.S.C. § 109(h) and is not eligible for relief under the United States Bankruptcy Code. Therefore, this case is dismissed, without prejudice.

IT IS FURTHER ORDERED that the trustee shall file a final report and account within thirty (30) days. Upon receipt of the final report and account, this case will be closed.

SO ORDERED.
