ORDER DENYING EX PARTE MOTION FOR LEAVE TO FILE NOTICE OF APPEAL IN THE TRADITIONAL MANNER

Debtor, through Appellate Counsel, having delivered to the Court for filing on February 20, 2007, an Ex Parte Motion for Leave to File Notice of Appeal (“Motion”) in the traditional manner, with reference to this Court’s February 8, 2007, Order Re Granting Cook Goetz Fee Application; there being a serious question as to Debtor’s standing to file such an appeal in any event; and it being the responsibility of the filing party to timely engage counsel who are capable of the required electronic filing, particularly in a situation where, as here, there is a ten day appear period which expired on or about February 20, 2007, and thus time may be a factor; ECF Procedure (b) authorizing traditional paper filing of this Motion only if permitted by the assigned judge for good cause; the Court concluding that the Motion does not, under the circumstances, assert good cause; now therefore,
IT IS HEREBY ORDERED that the said Motion is DENIED.
