This is my ruling on defendant Hechinger Company’s Hechinger”) motion for judgment on the pleadings (Doc. # 10).

Attached hereto is a copy of my memorandum opinion of this date in The Scotts Company vs. Hechinger Company, Adv. Proc. No. 00-1683 wherein I denied Hechinger’s motion to dismiss. Hechinger’s motion in that case is based on the same position taken by Hechinger in the instant case, namely, an alleged legally deficient reclamation demand letter. For the reasons set forth in the attached memorandum opinion, I deny Hechinger’s motion for judgment on the pleadings in the instant case.

ORDER
For the reason stated in the Court’s letter ruling of this date, the motion (Doc. # 10) of defendant Hechinger Company for judgment on the pleadings is DENIED.
