ORDER IN CONNECTION WITH DEBTOR’S MOTION REGARDING PROCEDURES IN A HEARING TO DETERMINE WHETHER THE GUARDIAN AD LITEM APPOINTMENT SHOULD BE TERMINATED AND RELATED RELIEF, AND SETTING HEARING IN CONNECTION THEREWITH AND MATTERS INCIDENT THERETO

The Court having concurrently entered its Opinion in Connection with Debtor’s Motion Regarding Procedures in the Competency Hearing and Related Relief; the matter of whether the guardian ad litem appointment should be terminated now being ripe for disposition;
Consistent with this Court’s Order of November 3, 2006, and subsequent related opinions, it is hereby further ordered that future proceedings on said matter will be governed by the following:
(A) Final Status Conference — An on the record final pre-hearing status conference shall take place on October 3, 2007, at 9:30 a.m.; and, incident thereto:
(1) on or before September 14, 2007, Debtor shall comply with (and serve upon the Guardian Ad Litem and his attorney and the trustee and his attorney) the expert testimony disclosure requirements of F.R.Civ.P. 7026(a)(2)(B); any other party intending to offer expert testimony shall similarly comply with said requirements by September 28, 2007; and serve such on Debtor and his Attorneys;

(2) At the status conference the Debtor and any other party intending to participate in the heading shall provide (a) a written list of the names and addresses of all witnesses it intends to call, and (b) a list and copies of all exhibits it intends to offer, at the hearing;
(B) Discovery — Discovery shall be permitted until October 19, 2007;
(C) Hearing Date and Exhibits — The evidentiary hearing to determine whether the appointment of the guardian ad litem should be terminated shall commence at 9:30 a.m. on October 31, 2007; with any continuation thereof on, November 1, 2007 at 2:00 p.m., and November 2, 2007, at 9:30 a.m.; to the extent not previously complied with at the status conference, the parties shall comply with the requirements of LBR 7016-1(d).
