This matter having come before the court on a motion to dismiss that portion of the plaintiffs complaint asserting the non-dischargeability of a debt pursuant to 11 U.S.C. § 523(a)(2)(A) in the above captioned adversary proceeding as it relates to the defendant, William S. Hammons, Sr.; and the court, having considered same, finds that the § 523 (a)(2)(A) count in the complaint is time barred as it relates to the defendant, William S. Hammons, Sr. Accordingly, the motion to dismiss is well taken and is hereby sustained.

This order does not affect the remaining § 523(a)(3) allegation raised in the complaint; nor does this order affect in any way the two remaining defendants in the adversary proceeding, William S. Hammons, Jr., and George A. Hammons.
