ORDER GRANTING OBJECTIONS TO CERTAIN CLAIMS IDENTIFIED IN THE PLAN ADMINISTRATOR’S OMNIBUS OBJECTION TO LATE FILED CLAIMS

This cause having come before the Court on the Plan Administrator’s Objection to Madison Square Garden’s Claim Number 1640, Leritz Contracting Inc.’s Claim Number 1666, and Midland Paper’s Claim Number 1716, as set forth in the Plan Administrator’s Omnibus Objection to Late Filed Claims (the “Omnibus Objection”), due and adequate notice of the Objection and the hearing thereon having been given to those parties entitled thereto, the Court having considered the requested relief and the statements of counsel and all other parties-in-interest, the Court being fully advised in the premises and for good cause shown,
IT IS HEREBY ORDERED, ADJUDGED AND DECREED THAT:
1. The Objection to the Madison Square Garden Claim Number 1640, as identified in the Omnibus Objection, is granted;
2. The Objection to Leritz Contracting Inc. Claim Number 1666, as identified in the Omnibus Objection, is granted; and
3. The objection to Midland Paper Claim Number 1716, as identified in the Omnibus Objection, is granted.
DISALLOWED CLAIMS
4. Madison Square Garden is currently holding a $25,000.00 security deposit, the property of the Estate. Madison Square Garden is directed to promptly return the $25,000.00 security deposit to the Plan Administrator.
5. This Order is made pursuant to the Court’s rulings from the bench on April 21, 2003; and
6. This is a final Order under 28 U.S.C. § 157 and 158.
No later than five (5) business days after the date of this Order, counsel for the Plan Administrator is directed to serve a copy of the order to all parties listed below and is directed to file a certificate of service no later than two (2) business days after service.
