Case No. 05-16984.United States Bankruptcy Court, N.D. Indiana, Fort Wayne Division.
December 16, 2005
DECISION AND ORDER
ROBERT GRANT, Bankruptcy Judge
The debtor has filed a motion to vacate the court’s order of November 10, 2005, which dismissed this case. While the motion may satisfactorily explain how an unsigned petition came to be filed with the court, it does not satisfactorily explain why counsel did not take any meaningful action in response to the court’s order of October 29, 2005, which identified the problems associated with this case, such as investigating what those problems may have been or taking some kind of action to correct them. Furthermore, the motion does not explain the almost one month delay between the order dismissing this case, which was issued on November 10, 2005, and the motion to vacate that order, which was filed on December 5. Given these deficiencies, together with the fact that the dismissal of the case is without prejudice to the debtor’s ability to file a further case, debtor’s motion to vacate the order of dismissal is DENIED.
SO ORDERED.
