ORDER DENYING PLAINTIFF’S MOTION FOR SUMMARY JUDGMENT

This adversary proceeding is before the Court on the motion for summary judgment filed by Plaintiff on September 11, 2008 (Docket # 18). The motion is untimely. Under the Court’s scheduling order filed May 19, 2008, the deadline for filing potentially dispositive motions in this case was August 15, 2008. See
Adversary Proceeding Scheduling Order (Docket # 13) (incorporating the motion deadline proposed by the parties in their Rule 26(f) report, Docket # 12). Plaintiff did not seek or obtain an order extending the August 15, 2008 motion deadline.

For these reasons,

IT IS ORDERED that Plaintiff’s motion for summary judgment (Docket # 18) is denied.
