ORDER TO SHOW CAUSE RE SMALL BUSINESS DEBTOR STATUS

The Debtor’s petition (and schedules) indicating that its aggregate noncontingent liquidated debts owed to non-insiders or affiliates are less than $2 million, which is one of the attributes of a small business debtor as defined under the statute; the said petition, however, also stating that Debtor is not a small business debtor as statutorily defined; thus, not being clear from Debtor’s filings whether or not it is a small business debtor; the status of Debtor as such being relevant to the contents of a Chapter 11 Case Management Order which the Court desires to issue;
IT IS HEREBY ORDERED that Debtor shall show cause on February15, 2007, at 11:00 a.m., in Judge Shapero’s Courtroom, Room 1042,of the Theodore C. Levin Federal Courthouse,231 W. Lafayette, Detroit, Michigan 48226, why it should not be treated as a small business debtor in connection with the administration of this bankruptcy case. If Debtor consents to being treated as a small business debtor it may do so by filing an appropriately amended petition prior to the hearing, in which case the hearing will not be held, and the appropriate Case Management Order will be issued. If Debtor does not so consent, the hearing will go forward.
