ORDER MODIFYING THE SERVICES PROVIDED BY BANKRUPTCY SERVICES L.L.C. AS OFFICIAL CLAIMS AND NOTICING AGENT AND TO TRANSFER CLAIMS REGISTER TO CLERK OF COURT RE: Docket 1249

Upon the Motion of Thermadyne Holdings Corporation (“Thermadyne Holdings”) and certain of its direct and indirect subsidiaries, as debtors and debtors in possession (collectively the “Debtors”), and upon the record herein; and after due deliberation thereon; and good and sufficient cause appearing therefore,
IT IS HEREBY FOUND THAT:
1. Due and proper notice of the Motion has been given, and no other or further notice is required;
2. The Debtors filed voluntary petitions under Chapter 11 on November 19, 2001. The Debtors’ filed a First Amended and Restated Joint Plan of Reorganization on January 17, 2003, which was confirmed by this Court on April 3, 2003. The Effective Date of the Plan was May 23, 2003.
3. Sufficient cause exists to grant the relief requested in the Motion.

IT IS THEREFORE ORDERED, ADJUDGED AND DECREED THAT:
4. The Motion is granted.
5. Bankruptcy Services LLC (“BSI”) shall only coordinate with the Debtors on future distributions to the general unsecured creditors.
6. The Debtors shall coordinate with BSI and the Clerk’s Office to transfer all data relating to the Claims Register and to ensure that any future information BSI may receive regarding claims is also transferred to the Clerk’s Office. Such transfer will be handled during the 30 days following the entry of this Order.
7. The Debtors shall make arrangements with the Clerk’s Office to retrieve the equipment used by the Clerk’s Office during the claims process within 30 days following the entry of this Order.
8. This Court shall retain jurisdiction to issue any additional orders that may be required to ensure complete transfer of all information.
9. No later than five (5) business days after the date of this order, Jennifer A. Merlo is directed to serve a copy of the order on all parties listed below and is directed to file a certificate of service no later than two (2) business days after service.
