This matter came on for consideration upon the Court’s own motion for purposes of entering an appropriate order in the above-captioned case. The Court reviewed the record and finds that Debtor, Kevin Adell, filed a Motion to Strike Creditor John Richards Homes Building Company, L.L.C.’s Objection to Motion for Abstention and Remand of Whall Group Adversary Proceeding [Adv. Pro. No. 9:03-ap-00801-ALP] (“Motion to Strike”). Inasmuch as JRH’s Objection was overruled in open court at the hearing held on February 5, 2004, this Court finds that the Debtor’s Motion to Strike should be denied as moot.

ORDERED, ADJUDGED AND DECREED that the Debtor’s Motion to Strike is hereby denied as moot.
