The court has received a request from the standing chapter 13 trustees in this district to modify the provisions currently set forth under Local Rule 6007-1(B)(2) for Abandonment of Property by the Trustee in Chapter 13 Cases. The current local rule provides that notice of abandonment of property shall be provided in the order confirming plan and chapter 13 trustee’s abandonment shall be deemed approved without necessity of a hearing or order if no objection to the abandonment is filed.
The chapter 13 standing trustees have advised the court that anticipated changes in statutory reporting requirements of trustees for reporting bankruptcy data are inconsistent with the general abandonment provisions of Local Rule 6007-1(B)(2) and if unchanged will result in unduly burdensome and otherwise unnecessary data collection and report preparation by the chapter 13 trustees. Accordingly it is
ORDERED that, for all unconfirmed cases pending on or after October 17, 2005, Local Rule 6007-1(B)(2) is abrogated and abandonment shall be pursuant to Bankruptcy Rule 6007.
