FINAL ORDER

On March 27, 2002, ANDA Partnership, Guardfish, L.L.C., Peninsula Capital Partners, L.P., and HBV Master Rediscovered Opportunities, L.P., filed an involuntary petition against Allied Riser Communications Corporation. On April 17, 2002, Allied Riser Communications Corporation filed a motion to dismiss the petition. On July 1, 2002, Allied Riser Communications Corp. filed an application for an award of attorney’s fees.
Based on the court’s findings of fact and conclusions of law rendered from the bench on June 11, 2002, and the findings of fact and conclusions of law contained in the court’s memorandum opinion dated August 8, 2002,
IT IS ORDERED that the involuntary petition is DISMISSED.
IT IS FURTHER ORDERED that the application for attorney’s fees is DENIED.
