ORDER ON TRUSTEE’S APPLICATION TO SELL PERSONAL PROPERTY AND PAY BROKER FEES

On June 17, 2005, the chapter 7 trustee filed his Application to Sell Personal Property and Pay Broker Fees with respect to 57 shares of SBC Communications, Inc. common stock. That motion proposed to pay a fee to Bank One for services in selling such stock. In the context of the sale, Bank One is a “professional person” within the meaning of 11 U.S.C. § 327(a), and thus the requirements of Fed.R.Bank.P. 2014(a) apply with respect to the utilization of Bank One in this sale’s transactions. Moreover, the application refers to the payment of a fee to Bank One “pursuant to their schedule of fees”, and there is nothing in the record at this time by which the Court can determine whether fees ultimately payable to Bank One for selling the stock are in accordance with the schedule merely generally referenced in the Application.

IT IS ORDERED that the Court will take no action with respect to the application until there has been compliance with the provisions of Fed.R.Bank.P. 2014(a) with respect to Bank One.
