STIPULATION AND CONSENT ORDER RESOLVING U.S. TRUSTEE’S MOTION TO CONVERT OR DISMISS

The U.S.Trustee moved to convert or dismiss. The Debtor has cured most of the grounds for the motion, except for the filing of a plan and disclosure statement. The Debtor and U.S.Trustee are agreed that the Debtor shall file these documents no later than March 2, 2009.
If the debtor fails to comply with the above terms, the U.S.Trustee may certify the failure (with notice to the debtor’s counsel), and the case may be dismissed without further hearing, unless the debtor, for good cause shown, objects within five (5) business days, and thereupon a hearing may be scheduled.
Finding these terms to fairly and reasonably resolve the U.S.Trustee’s pending motion (currently set for hearing on January 27, 2009), this Stipulation and Consent Order is hereby APPROVED.
