ORDER

Consistent with the Memorandum Opinion this day entered,

IT IS HEREBY ORDERED that the Application for Compensation that Michael L. Baker (the “Applicant”) filed in the above-styled case on April 7, 2004 is hereby sustained and the Trustee’s Objection [to] Application to Pay Administrative Expenses and Demand for Turnover of Property of the Estate that was filed on April 26, 2004 is overruled. More particularly, the Applicant is allowed a secured claim in the amount of $9,170.00 and an unsecured Chapter 11 administrative expense in the amount of $3,514.60 for services rendered and expenses incurred by the Applicant as attorney for the debtor in possession prior to the conversion of this case to Chapter 7. It is further ordered that the Applicant may apply the balance of the retainer received prepetition to the satisfaction of such secured claim, but shall not receive payment of such Chapter 11 administrative expense until further order of the court.
