Alan M. Grochal, Liquidating Agent for the bankruptcy estate of Baltimore Marine Industries, Inc. (the “Liquidating Agent”) and Madonna Finishes, Inc. (“Madonna”), by and through their undersigned attorneys hereby stipulate as follows:
WHEREAS on June 8, 2005, the Liquidating Agent filed a complaint to avoid certain preferential transfers made by Baltimore Marine Industries, Inc. to Madonna (the “Complaint”); and
WHEREAS on August 27, 2007, this Court entered a Scheduling Order setting October 5, 2007 as the deadline to file its Answer or other responsive pleading to the Complaint filed by the Liquidating Agent; and
WHEREAS, the Liquidating Agent has agreed to extend the time which with Madonna shall have to file its response to the Complaint; it is hereby
ORDERED that Madonna may file its response to the Complaint through and including October 19, 2007, which date may be further extended by agreement or order of this Court.
