Upon consideration of Debtor’s Objection to Proof of Claim Number 885 Filed by Gary Norton (the “Objection”) filed by Encompass Services Corporation and certain of its direct and indirect subsidiaries (collectively the “Debtors”), seeking expungement and disallowance of proof of claim number 885 filed by Creditor Gary Norton and Creditor Gary Norton’s Response to Debtors Objection to Proof of Claim Number 885 Filed by Gary Norton and, upon hearing thereon, the Court finds that there is insufficient basis for Debtors Objection to Creditor Gary Norton’s Proof of Claim, that genuine issues of fact remain to be determined, and, that dismissal and expungement of the claim is not in the best interest of Creditor Gary Norton,

NOW THEREFORE, it is hereby

ORDERED that Debtors Objection to Proof of Claim Number 885 filed by Gary Norton is denied in all respects.

SO ORDERED.
