On September 3, 2003 this Court considered Bio-Mass Tech, Inc.’s Motion to File Late Proof of Claim (Docket #2181) (the “Motion”) and the Response thereto filed on behalf of the Disbursing Agent for the referenced Debtors (“Response”). The Court, after reviewing the Motion and the Response and considering the record in the case and the arguments of counsel, finds that the Motion, and all relief requested therein should be DENIED. It is therefore,
ORDERED that all relief requested in Bio-Mass Tech, Inc.’s Motion to File Late Proof of Claim is hereby is DENIED and, therefore, Bio-Mass Tech, Inc. shall not be entitled to any distribution from the bankruptcy estates of the referenced Debtors.
