ORDER DISALLOWING PROOF OF CLAIM BY CONNECTICUT REGARDING UNCLAIMED PROPERTY (CLAIM NO. 6104) PURSUANT TO THE CLAIMS ESTIMATION PROCEDURES

Upon consideration of the Debtors’ Verified Objection to Proof of Claim by Connecticut Regarding Unclaimed Property (Claim No. 6104), Pursuant to the Claims Estimation Procedures, dated August 22, 2004 (the “Objection”), seeking the estimation of a proof of claim filed by the Unclaimed Property Division of the Office of the State Treasurer of the State of Connecticut (the “Claimant”) asserting a claim to unclaimed property (the “Claim”) at zero dollars pursuant to that certain Order, Pursuant to Sections 105(a), 363(b) and 502(c) of the Bankruptcy Code and Federal Rules of Bankruptcy Procedure 3018, 7042, and 9019, (1) Establishing Procedures to Estimate Unliquidated and Contingent Claims, (2) Establishing Procedures to Estimate Counterclaims, (3) Establishing Procedures to Compromise Claims and Counterclaims and (4) Fixing Notice Procedures and Approving Form and Manner of Notice (the “Estimation Order”), good and sufficient notice of the Objection and of the deadlines and procedures for responding to the Objection as set forth in the Estimation Order having been provided to the attorneys for the statutory committee of unsecured creditors, the Office of the United

States Trustee for the Southern District of New York, counsel to the Employment-Related Issues Committee, the Claimant and its attorneys (if known), and any other parties on the Debtors’ Master Service List; and it appearing that no other or further notice need be provided; and the Court having reviewed the Objection; and no response to the Objection having been received from or filed by the Claimant within the initial thirty (30) day notice period or the fifteen (15) day grace period provided for in the Estimation Order; and the Court having determined that the legal and factual bases set forth in the Objection establish just cause for the relief granted herein; and upon all of the proceedings had before the Court; and after due deliberation and sufficient cause appearing therefor, it is
ORDERED that the Debtors’ Objection is allowed; and it is further
ORDERED that claim number 6104 filed by the Unclaimed Property Division of the Office of the State Treasurer of the State of Connecticut is hereby disallowed and expunged.
