ORDER GRANTING CHAPTER 11 TRUSTEE’S MOTION FOR AN EXPEDITED HEARING ON THE TRUSTEE’S MOTION FOR RELIEF IN AID OF THE SALE TO GPM INVESTMENTS, LLC

This matter came before the Court on the Motion of Keith L. Phillips (the “Trustee”), the duly appointed Chapter 11 Trustee for the above-captioned debtors (the “Debtors”), for an Expedited Hearing on the Chapter 11 Trustee’s Motion for Relief in Aid of the Sale to GPM Investments, LLC (the “Motion”). The Court finds that (i) a need for an emergency hearing exists with respect to the relief requested by the Motion, (ii) the Trustee did not, through any lack of due diligence, create the need for an emergency hearing, and (iii) the Trustee has made a bona fide effort to resolve the matters addressed by the Motion prior to seeking an expedited hearing. The Court, therefore, finding it reasonable and necessary to do so, hereby ORDERS that:
1. A hearing to consider the Motion shall be conducted by the Court on February 27, 2003, at 11:30 a.m.
2. The Clerk of Court shall send a copy of this Order as entered to the Trustee’s counsel at the address below who shall then immediately file and serve a notice in these bankruptcy cases notifying parties in interest of the scheduling of the hearing.
