Telephonic status conferences were held November 20, 2003 and November 26, 2003, on creditor BP Products North America’s emergency motion to adjourn hearing on motion for reconsideration and to compel compliance with discovery. Upon consideration of the arguments of counsel, the court will grant the motion nunc pro tune to the date of the first status conference. The court will continue the hearing on the motion for reconsideration from its originally scheduled date, November 25, 2003, to December 22, 2003. The court will also allow a total of eight hours in which counsel for BP Products may take depositions of trustee’s witnesses Keith L. Phillips, Guy A. Davis, and Thomas M. Terry. Accordingly,

IT IS ORDERED that BP’s motion is GRANTED nunc pro tune to November 20, 2003, regarding adjournment of the hearing on the motion for reconsideration. The hearing is continued to December 22, 2003.

IT IS FURTHER ORDERED that BP’s motion is GRANTED
nunc pro tune to November 20, 2003 regarding the scheduling of depositions. Counsel for BP Products may use a total of eight hours in which to depose Keith L. Phillips, Guy A. Davis, and Thomas M. Terry.
