ORDER APPROVING SETTLEMENT AGREEMENT REGARDING POLLUTION CONTROL FINANCING AUTHORITY OF CAMDEN COUNTY CLAIMS PURSUANT TO FED. R. BANKR. P. 9019

Upon the Motion[2] of the debtors and debtors in possession in the above-captioned cases (collectively, the “Debtors”) seeking entry of an order approving the Agreement; and the Court having jurisdiction over this matter pursuant to 28 U.S.C. §§ 157 and 1334; and the Court finding that this is a core proceeding pursuant to 28 U.S.C. § 157(b)(2); and upon consideration of the Motion; and due and proper notice of the Motion having been given; and the parties having executed the Agreement; and the Court having determined that just cause exists for the relief granted herein; it is hereby

ORDERED that the Agreement is approved in its entirety; and it is further
ORDERED that Claim 1873 shall be allowed as a general unsecured claim against Sherman Wire in the amount of $750,000.00 for all purposes; and it is further
ORDERED that Claims 2536 and 2400 shall be disallowed for all purposes; and it is further
ORDERED that the Allstate Insurance Company is authorized to pay $75,000 directly to the PCFA; and it is further
ORDERED that nothing herein is intended, or shall be construed, to: (1) affect the liability of any party other than Sherman Wire Company (f/k/a DeSoto, Inc.) (“DeSoto”) or (2) determine the share of liability allocated to DeSoto or any party in the New Jersey Litigation styled Pennsauken Solid Waste Management Authority, et al. v. Ward Sand Material Co., Inc., et al.,
filed in the Superior Court of New Jersey, Camden County under docket no. L-13345-91 or in any other New Jersey litigation regarding the subject matter of that suit; and it is further
ORDERED that this Court shall retain jurisdiction to hear and determine any disputes between the PCFA and DeSoto arising from or relating to the settlement referred to herein.
