CASE NO. 10-24432 JPK.United States Bankruptcy Court, N.D. Indiana, Hammond Division.
January 11, 2011
ORDER REGARDING MOTION FOR 2004 EXAMINATION OF DEBTOR, JOHNNY REUBEN GAUGHT AND DEBTOR’S ACCOUNTANT (“MOTION”)
J. PHILLIP KLINGEBERGER, Bankruptcy Judge
The most obvious failing of the Motion is that it seeks an order regarding Rule 2004 examinations with respect to two separate individuals. A motion for a Rule 2004 examination is directed to a singular event, i.e., examination of “any entity” pursuant to Fed.R.Bankr.P. 2004(a). It is not permissible to seek an examination of more than one entity, or person, in a motion.
IT IS ORDERED that the Motion is denied, without prejudice to the seeking of relief in accordance with applicable law and rules, i.e., by the filing of a separate motion with respect toeach entity sought to be examined under Fed.R.Bankr.P. 2004.
