ORDER SUSTAINING THIRD OMNIBUS OBJECTION OF THE POST-CONFIRMATION COMMITTEE OF UNSECURED CREDITORS OF HA2003, INC. TO CLAIMS
A. BENJAMIN GOLDGAR, Bankruptcy Judge

This cause coming to be heard on the continued hearing of the Third Omnibus Objection to Claims Pursuant to 11 U.S.C. §§ 105(a) and 502(b), and Fed.R.Bankr.P. 3007, of the Post-Confirmation Committee of Unsecured Creditors of HA2003, Inc., et al., (the “PCC”) and request for approval of shortened notice (the “Third Omnibus Objection”); notice of the Third Omnibus Objection having been given to all affected creditors; the Court having heard any arguments of counsel for the PCC and any claimant subject to the Third Omnibus Objection; certain aspects of the Third Omnibus Objection having been continued from the July 21, 2004 hearing; and the Court being otherwise fully advised in the premises; ITIS HEREBY ORDERED THAT:

A. The Claims listed on Exhibit 1 attached hereto shall be continued to September 22, 2004 at 11:00 a.m.

B. Claim no. 1859 of Marilyn and Walter Marchetti is allowed as a non-priority, unsecured claim in the amount of $2,162.76.

C. Claim no. 1882 of Clegg Industries is allowed as a non-priority, unsecured claim in the amount of $11,247.30.

D. The Third Omnibus Objection is sustained as to the claim of Nilesh N. Shah (claim no. 1060) and Richard J. Siegel (claim no. 2146). Accordingly, such claims shall be treated as provided for in Exhibit A to the Third Omnibus Objection.

E. This Court shall retain jurisdiction over the PCC and the Claimants whose claims are subject to the Objection with respect to any matters related to or arising from the implementation of this Order.

F. This Order is without prejudice to the rights of the HA2003 Liquidating Trust and the PCC to object to any other claims in these chapter 11 cases or to further object to any Claims objected to herein on any basis or for any reason, subject to the terms of the Plan.
