ORDER DISALLOWING RECLAMATION CLAIMS ASSERTED BY ALPHA SHIRT COMPANY, CLAIMS NOS. H84 TO H410 AND L56 TO L169

Upon consideration of the HA2003 Liquidating Trust’s Omnibus Objection To And Request For Disallowance Of Reclamation Claims And Approval of the Final Reclamation Report (the “Objection”),[1] the statements made by counsel at the January 19, 2005 hearing held in connection therewith, and the settlement agreement between Alpha Shirt Company and the Post-Confirmation Committee that was approved by the Court on September 24, 2004; and the Court having jurisdiction to hear the Objection; and it appearing that sufficient notice of the Objection has been given; and it appearing that the relief requested by the Objection is appropriate; and good cause having been shown,

IT IS HEREBY ORDERED THAT

1. The reclamation claims asserted by Alpha Shirt Company, designated in the Final Reclamation Report as Claim Nos. H84 to H410 and L56 to L169 (the “Reclamation Claims”), are disallowed in their entirely.

2. This Court shall retain jurisdiction over the Liquidating Trust and Alpha Shirt Company with respect to any matters related to or arising from the implementation of this Order.
