AGREED ORDER RESOLVING LEASE CLAIMS FOR KMART STORE NO. 3770
SUSAN SONDERBY, Chief Judge, Bankruptcy

Upon consideration of the lease claims (“Claims”) filed by Latter Blum Property Management, under the Lease of the properties described as Store No. 3770 located in Dallas, Texas and Kmart Corporation (“Kmart”) having filed an objection to Latter Blum Property Management’s claims; and the Court being advised that Latter Blum Property Management and Kmart have resolved the Claims; and after due deliberation and sufficient cause appearing therefore, it is hereby

ORDERED that upon entry of this Order, Latter Blum Property Management’s claims against or arising out of Store 3770 shall be expunged in their entirety; and it is further

ORDERED that Latter Blum Property Management and its successors, assigns or designees, are forever barred from asserting, collecting, or seeking to collect any other claims or amounts with respect to the Lease relating to Kmart Store No. 3770.
