AGREED SCHEDULING ORDER RE: OBJECTION TO CLAIMS OF IBJ WHITEHALL BUSINESS CREDIT CORPORATION (DOCKET NO. 18082)

Upon consideration of Kmart’s Objection to Claims of IBJ Whitehall Business Credit Corporation (“IBJ Whitehall”) (Docket No: 18082) (the “Objection”), and the Court having been advised that the parties have agreed to the form of this Order, it is hereby Ordered as follows:

1. The deadline for IBJ Whitehall’s response to the Objection, Kmart’s Nineteenth Omnibus Objection as it pertains to claim 2564, and Kmart’s Twentieth Omnibus Objection as it pertains to claim 53112 is adjourned to a date 30 days after the Court enters an order adjudicating the disputes concerning the Motions to Assume the Varilease Leases.

2. Consideration of the Objection, Kmart’s Nineteenth Omnibus Objection as it pertains to claim 2564 and Kmart’s Twentieth Omnibus Objection as it pertains to claim 53112, filed by IBJ Whitehall, shall be continued for status hearing on December 14, 2004 at 10:00 a.m.
