ORDER VACATING AMENDED ORDER DISALLOWING AND EXPUNGING OR OTHERWISE REDUCING OR RECLASSIFYING CERTAIN CLAIMS SET FORTH IN THE NINETEENTH OMNIBUS OBJECTION WITH RESPECT TO CLAIM NUMBER 43494

Upon consideration of the Kmart’s Nineteenth Omnibus Objection to Claims (Docket No. 20650) (the “Objection”), this Objection shall be withdrawn as it relates to claim number 43494, without prejudice to right of Kmart Corporation and certain of its subsidiaries and affiliates, former debtors and debtors-in-possession in the above-captioned cases (collectively, “Kmart”), to file any future objections to this claim, and recognizing that Kmart fully reserves all other rights and defenses. Any provision in the Amended Order Disallowing and Expunging or Otherwise Reducing or Reclassifying Certain Claims Set Forth in the Nineteenth Omnibus Objection (Docket No. 23791) inconsistent with the foregoing is hereby vacated.
