ORDER SETTING FURTHER HEARING ON APPLICATION TO WAIVE FILING FEE AND ORDER TO SHOW CAUSE

This case having been filed initially as a Chapter 13 case on January 14, 2008; incident thereto in response to an application to pay the filing fee in installments the Court having entered an order on January 15, 2008, approving payment of said fee in three installments, the last being due March 10, 2008; the said fees having not been fully paid; the case having been voluntarily converted to a Chapter 7 case on February 15, 2008, and an order to that effect having been entered on March 5, 2008; the Court having issued on March 25, 2008, an Order to Show Cause on April 17, 2008, why the case should not be dismissed for failure to have paid the filing fee; the said order requiring both the Debtor and the attorney for the Debtor to appear at said hearing; the Debtor having filed an Application to Waive the Chapter 7 filing fee on April 8, 2008, the Debtor having appeared at the April 17, 2008, hearing, but not Debtor’s attorney as the hearing order required; it appearing at the hearing that Debtor was confused as to the status of the case and the nature and extent of his legal representation, but desiring to continue his bankruptcy case;

IT IS HEREBY ORDERED that on May 1, 2008, at 9:30 a.m., a further hearing shall be held on (1) Debtor’s Application to Waive the Chapter 7 Filing fee; (2) the Order to Show Cause initially set for April 17, 2008, and in particular the failure of Debtor’s attorney, Deborah Maria Weihermuller, to have appeared at said hearing; (3) the status of this bankruptcy case.
