ORDER GRANTING SECOND EXTENSION OF TIME TO ASSUME OR REJECT UNEXPIRED LEASES OF NONRESIDENTIAL REAL PROPERTY

Upon consideration of the Debtors’ Second Motion for an Extension of Time to Assume or Reject Unexpired Leases of Nonresidential Real Property (the “Motion”), together with any response filed thereto, after notice and a hearing, and the Court finding good cause for the relief requested thereby it is hereby

ORDERED that the Motion is granted; and it is further

ORDERED that the Debtors’ time to assume or reject their unexpired leases of nonresidential real property (the “Leases”) is extended to the earlier of: (i) the date on which an Order is entered confirming the Debtors’ Plan;[1] and (ii) September 16, 2004; and is is further

ORDERED that this extension is without prejudice to the Debtors’ right to request a further extension of time to assume or reject the Leases upon a showing of cause, or the right of any non-debtor party to the Leases to request this Court to fix an earlier date by which the Debtors must assume or reject any particular Lease.

Counsel for the Debtor shall immediately serve a copy of this Order on all parties on the Official Service List, the 2002 Service List, and any other parties in interest and file a certificate of service with the Clerk of the Bankruptcy Court within ten (10) days hereof.
