ORDER

The above-captioned case came before the Court on May 4, 2004, for hearing on a motion to dismiss counterclaim and motion to strike jury demand in the counterclaim filed by Plaintiff. (Doc.Nos. 16,17). As counsel for the Defendant stated at the hearing that he wished to withdraw the counterclaim, the Court determined these motions to be moot.
Accordingly, and for good cause found,
IT IS ORDERED, ADJUDGED and DECREED that the motion to dismiss counterclaim and the motion to strike jury demand filed by Plaintiff (Doc. Nos. 16,17) are hereby DISMISSED as moot.
IT IS FURTHER ORDERED AND DIRECTED that the Clerk of this Court shall send a copy of this order by means of the Bankruptcy Noticing Center to each of the following (which shall be sufficient service and notice thereof): all parties in interest.
