In re: SHARON KAY MURRAY, Debtor.

CHAPTER 7 Case No. 07-41134.

United States Bankruptcy Court, E.D. Michigan

December 05, 2011.

ORDER DISMISSING CASE
Thomas J. Tucker, United States Bankruptcy Judge.

On November 4, 2011, the Court entered an order entitled “Order Denying, Without Prejudice, Motion for Hardship Discharge” (Docket # 80, the “November 4 Order”), which provided in relevant part:

IT IS ORDERED that the Motion [for Hardship Discharge] (Docket # 78), is denied, without prejudice to the right of a duly appointed personal representative of the deceased Debtor to file a motion for hardship discharge under 11 U.S.C. § 1328(b). But any such motion must be filed no later than December 2, 2011, or the Court may dismiss this Chapter 13 case under Fed.R.Bankr.P. 1016, without further notice or hearing.

No duly appointed personal representative of the deceased Debtor filed a motion for hardship discharge by the December 2, 2011 deadline in the Court’s November 2 Order.

Accordingly,

IT IS ORDERED that this bankruptcy case is dismissed under Fed.R.Bankr.P. 1016, due to the death of the Debtor.
