ORDER APPROVING USE OF PROPERTY OF ESTATE TO CONDUCT SOIL AND GROUNDWATER SAMPLING (RETROACTIVE TO NOVEMBER 17, 2003)

This cause coming to be heard on the Trustee’s Motion For Authority To Use Property Of Estate To Conduct Soil And Groundwater Sampling Retroactive To November 17, 2003 (the “Motion”); due notice of the Motion having been provided; the Court having heard any arguments of counsel; and based upon the record at the hearing, IT TS HEREBY ORDERED THAT:

1. The Court has jurisdiction over the Motion pursuant to 28 U.S.C. § 1334, The Motion and this Order constitute a core proceeding pursuant to 28 U.S.C, § 157.

2. Trustee is authorized to use estate funds to pay for soil and groundwater sampling at the Property (defined in the Motion), with such approval retroactive to November 17, 2003. Specifically, Trustee is authorized to use his discretion in selecting contractors to perform such services and to pay such contractors in accordance with Section 503(b) of the Bankruptcy Code without further approval of this Court, except however, that if the total cost of the services approved herein exceeds by fifteen percent (15%) the estimated total of $30,800 in the Motion, then Trustee shall move this Court for additional authority for such expenditure.
