ORDER ALLOWING INTERIM COMPENSATION AND REIMBURSEMENT OF COSTS AND EXPENSES TO CONESTOGA-ROVERS ASSOCIATES, ENVIRONMENTAL CONSULTANTS TO TRUSTEE (THIRD APPLICATION)

This cause coming to be heard on Trustee’s Third Interim Fee Applications to pay Conestoga-Rovers Associates, Environmental Consultant to Trustee (the “Application”); due notice having been given; the Court having heard the statements of counsel present; and the Court being fully advised in the premises; the Court hereby enters the following FINDINGS:

1. That in the Application, Trustee requested permission to pay CRA $31,872.50 for 335.0 hours for professional services rendered from February 28, 2005 to June 26, 2005;

2. That in the Application, Trustee requested permission to reimburse CRA $1,011.48 as its actual reasonable and necessary expenses incurred or accrued in connection with such services;

NOW, THEREFORE, IT IS HEREBY ORDERED:

A. That the Court authorizes Trustee to pay CRA $31,872.50 as compensation for actual, necessary and valuable professional services rendered to the Trustee from February 29, 2005 through June 26, 2005;

B. That the that Court authorizes Trustee to pay CRA $1,011.48 for reimbursement for actual, reasonable and necessary expenses incurred in connection therewith; and

C. That this matter is a core proceeding.
