This cause came before the Court on November 8, 2005 for preliminary hearing and it appearing to the Court from statements of counsel for the movant that the parties are in agreement that the preliminary hearing should be rescheduled, it appears the request is well taken and should be granted;
IT IS ACCORINDGLING ORDERED that the preliminary hearing in this matter be continued and reset for Tuesday, December 6, 2005 commencing at 8:30 a.m. Courtroom 1, 701 Broadway, Nashville, Tennessee 37203.
IT FURTHER ORDERED that the stay shall remain in effect pending further orders of the Court.
