ORDER REASSIGNING CHAPTER 11 BANKRUPTCY CASE
STEVEN RHODES, Chief Bankruptcy Judge

On January 31, 2008, Debtor filed a voluntary petition for relief under Chapter 11, and the case was assigned to Judge Steven W. Rhodes. It appears that this Chapter 11 case was a “companion case” to the Chapter 11 case previously filed (on January 30, 2008) by Otzer Capital, LLC (Case No. 08-42107) (assigned to Judge Tucker), within the meaning of L.B.R. 1071-1(c)(3) (E.D.M.).[1] The two corporations are “affiliated corporations” within the meaning of this local rule, because they are each 100 % owned by the same individual, Stanley Gestetner.[2] See, e.g., 11 U.S.C. § 101(2)(B) (defining “affiliate”).

It is the practice of this Court, under L.B.R. 1071-1(e)(1) (E.D.M.), to reassign all subsequently filed “companion cases” to the Judge to whom the first case was assigned. Accordingly, the undersigned judges have concluded that this case should be reassigned to Judge Tucker. Therefore,

IT IS ORDERED that this Chapter 11 case is reassigned to United States Bankruptcy Judge Thomas J. Tucker, and that the case be removed from the docket of Chief Judge Rhodes

and transferred to the docket of Judge Tucker.

[1] This Otzer Capital case was dismissed by the Court on February 22, 2008, then refiled later the same day as Case No. 08-44063 (and again assigned to Judge Tucker), which case remains pending.
