ORDER GRANTING DEBTORS’ MOTION TO WITHDRAW WITHOUT PREJUDICE THEIR CONDITIONAL MOTION UNDER SECTION 1113(c)

These administratively consolidated cases having cases before the Court on Debtors’ Motion to Withdraw Without Prejudice Their Conditional Motion Under Section 1113(c). Having considered the filing, the Court rules on the matter as follows:

1. The Court has core jurisdiction over the debtors’ cases, the pending motion, and the affected parties and property pursuant to 28 U.S.C. § 157(b) and 1334.

2. Proper and adequate notice of the motion has been given.

3. The motion is GRANTED and the Debtors may withdraw their conditional Section 1113(e) motion without prejudice to resubmitting the motion at a later date.

4. Notwithstanding the possible applicability of Bankruptcy Rules 7062, 9014 or otherwise, this Order shall take effect immediately upon entry. This Court retains jurisdiction with respect to all matters arising from or related to the implementation of this Order.
