ORDER ON MOTION FOR DISALLOWANCE AND TURNOVER OF PETITION PREPARER FEES AND/OR ASSESSMENT OF FINES

This matter having been heard on December 3, 2003, the parties having received due notice and the court being apprised of the facts, based on the Memorandum Opinion of even date,
IT IS HEREBY ORDERED THAT:
1. The fee paid by the debtor to Cynthia Kernats in the amount of $200,00 is disallowed;
2. Cynthia Kernats is ordered to turn over the $200 disallowed fee in the form of money order or cashier’s check made payable to the Chapter 13 Trustee, Marilyn O. Marshall, 224 So. Michigan Avenue, Suite 800, Chicago, Illinois 60603, within 30 days;
3. Cynthia Kernats is fined $25.00 for her violation of § 110(g); and
4. Cynthia Kernats shall forward the $25.00 fine in the form of money order or cashier’s check, made payable to the Clerk of the Bankruptcy Court, 219 South Dearborn Street, Chicago, Illinois 60604.
THE COURT HEREBY FINDS AND CERTIFIES TO THE DISTRICTCOURT:
1. Cynthia Kernats, residing at 1488 Creekwood Drive, Orland Park, Illinois 60647, prepared the documents to be filed in this case on behalf of the debtor and is a bankruptcy petition preparer as defined by 11 U.S.C. § 110;

2. Cynthia Kernats accepted the filing fee from the debtor and paid it to the clerk of the court in connection with this case in violation of § 110(g);
3. Cynthia Kernats’s actions in completing the schedules, in completing a plan, and in preparing a motion to vacate the dismissal of this case constitute the unauthorized practice of law.
4. The preceding facts are properly certified to the District Court pursuant to 11 U.S.C. §
