ORDER APPROVING SETTLEMENT AGREEMENT BETWEEN CITY OF CAMBRIDGE, THE PLAN COMMITTEE AND THE DEBTORS

On August 1, 2003, the Plan Committee (the “Committee”) in these Chapter 11 cases of Washington Group International, Inc., et al, (the “Debtors”) filed a Motion (“Motion”) pursuant to F.R.Bankr.P. 9019, for approval of the terms of a settlement (the “Settlement”) agreed to with the Debtors and the City of Cambridge, Massachusetts (“Cambridge”). The Settlement resolves the claim of Cambridge against the Debtors’ estates, including but not limited to the Claim Cambridge previously filed against the Debtors in these bankruptcy cases (Claim No. 12975). As set forth in the Settlement, the Debtors, with approval of the Committee, and Cambridge have agreed, inter alia, that Cambridge shall receive an Allowed Class 7 Claim in the amount of $250,000.00, and that the Debtors shall be released from all claims or causes of action arising out of or relating to the Cambridge Claim.

The Motion was filed on negative notice. The deadline to file objections to the Motion was August 25, 2003. No objections were filed.
After reviewing the Notice of the Motion, the Motion, and the Declaration of Michael Pagni in support of entry of the Motion, and good cause appearing therefor;
IT IS HEREBY ORDERED that the Motion is granted;
IT IS FURTHER ORDERED that the settlement is approved and that the City of Cambridge, Massachusetts shall have an ALLOWED Class 7 Claim, number 12975, in the total amount of $250,000.
