STIPULATION AND ORDER GRANTING EXTENSION OF TIME TO OBJECT TO CLAIM NO. 14927

The United States, on behalf of the United States Department of Agriculture Forest Service (“United States”) and the Plan Committee, formerly the Official Unsecured Creditors’ Committee (the “Committee”) appointed in the Chapter 11 bankruptcy cases of Washington Group International, Inc., et al. (collectively, the “Debtors”), hereby stipulate and agree as follows:
WHEREAS, on May 14, 2001, the Debtors filed voluntary petitions for relief under Chapter 11 of Title 11 of the United States Code, 11 U.S.C. § 101, et seq.
(the “Bankruptcy Code”).
WHEREAS, the Court confirmed the Second Amended Joint Plan of Reorganization of Washington Group International, Inc. et al., As Modified, pursuant to the Confirmation Order and the Plan became effective on January 25, 2002.
WHEREAS, pursuant to Section 8 of the Court Order Confirming the Second Amended Joint Plan of Reorganization of Washington Group International, Inc., et al., As Modified, entered and filed on December 21, 2001 (the “Confirmation Order), the Committee was authorized to prosecute, settle, and otherwise resolve Class 7 (unsecured) Claims in these Chapter 11 cases.
WHEREAS, the United States filed three (3) separate proofs of claim on behalf of the Forest Service in Case Nos. BK-01-31627, which claims were consolidated by stipulation and order into one surviving claim, identified as Claim No. 14927, in the estimated amount of $76,683,000;
WHEREAS, by Order entered on January 29, 2003, this Court required that all objections to unsecured Claims be filed no later than March 31, 2003;
WHEREAS, the Committee and the United States have been diligently cooperating in the investigation of this Claim and whereas the Committee believes that significant insurance may be available to assist in the satisfaction of this Claim; and
WHEREAS, the Committee and the United States desire to concentrate their efforts on achieving a negotiated settlement with the cooperation of the insurers and believe that those efforts could be prejudiced if the Committee is required to file a formal objection to the Claim within the time limits specified by the Court;
NOW THEREFORE, the Parties request that the Court allow an extension of time until May 31, 2003, for the Committee to object to the Claim.
