ORDER REGARDING SEALED DOCUMENTS ERRONEOUSLY LABELED IN RELATED CASE NO. 02-42324

WHEREAS, this Court entered an order on October 29, 2002, (the “October 29 Order”) that, among other things, authorized the above-captioned debtors and its agents (collectively “WorldCom” or “Debtors”) to file Confidential Information under seal; and

WHEREAS, pursuant to the October 29 Order, WorldCom submitted Confidential Information regarding WorldCom related case no. 02-42324 (the “Related Case”) on November 4, 2002, that was subsequently discovered to have been erroneously labeled (the “Erroneous Documents”); and

WHEREAS, upon discovery of the Erroneous Documents WorldCom is desirous of having, and has, resubmitted Confidential Information for the Related Case; and

WHEREAS, counsel for WorldCom has requested that the Clerk of the United States Bankruptcy Court for the Southern District of New York (the “Clerk”) destroy, or otherwise, dispose of the Erroneous Documents; and

WHEREAS, the Clerk seeks authorization from the Court to destroy, or otherwise, dispose of the Erroneous Documents.

NOW, THEREFORE, it is hereby

ORDERED, that the Clerk is authorized to destroy, or otherwise, dispose of the Erroneous Documents in all mediums submitted; and it is further

ORDERED, that this Order shall be docketed in both WorldCom’s main case (02-13533) and the Related Case (02-42324).
