SCHEDULING ORDER WITH RESPECT TO DEBTORS’ OBJECTION TO CLAIM NO. 3221 FILED BY THOMAS SIMPSON
ARTHUR GONZALEZ, Bankruptcy Judge
Pursuant to Rule 7026 of the Federal Rules of Bankruptcy Procedure, the following scheduling order shall govern with respect to discovery in this bankruptcy proceeding between MCI, Inc. (f/k/a/ Worldcom, Inc.) and certain of its affiliates and Thomas Simpson (the “Parties”):
1. On or before March 1, 2005, the Parties shall exchange the information required by Rule 26(a)(1), FEDERAL RULES OF CIVIL PROCEDURE, incorporated into bankruptcy proceedings pursuant to RULE 7026, FEDERAL RULES OF BANKRUPTCY PROCEDURE;
2. On or before April 1, 2005, the Parties shall exchange those documents referred to in their respective Rule 26(a)(1) initial disclosure statements;
3. On or before October 1, 2005, the Parties shall complete all discovery;
4. On or before June 1, 2005, the party with the burden of proof on an issue that is the subject of expert testimony shall, without the necessity of any interrogatory, comply with FRCP 26(a)(2) and depositions of such experts shall be completed on or before July 1, 2005. A party who expects to call an expert witness inPage 2
response to an expert so disclosed shall, without the necessity of an interrogatory, comply with FRCP 26(a)(2) on or before August 1, 2005, and depositions of such experts shall be completed on or before September 1, 2005. A party who expects to call an expert witness for purposes of rebuttal shall, without the necessity of any interrogatory, comply with FRCP 26(a)(2) within thirty (30) days of the disclosure of the expert witness whose testimony is the subject of the rebuttal testimony and depositions of such experts shall be completed within thirty (30) days of such compliance with FRCP 26(a)(2);
5. The deadline for filing dispositive or partially dispositive motions is November 1, 2005.
6. The requirements of Local Bankruptcy Rule 7056-1(a) are hereby suspended in this matter.
